EB-5 Immigrant Investors Visas


The EB-5 classification includes 10,000 immigrant visas per year set aside for any foreign nationals who meet the following conditions


  1. Engaging/starting in a new commercial enterprise in the U.S. This may involve creating an original business, or purchasing an existing business in the U.S. or restructuring/reorganizing the existing business into a new commercial enterprise, or expanding an existing business by 140 percent of the pre-investment number of jobs or net worth, or retaining all existing jobs in a troubled business which has lost 20% of its net worth over the last 1 or 2years, and

  2. Showing that the new enterprise will either directly or indirectly create 10 or more jobs



The 2 Categories of Investors


Individual investors may qualify if their investment in a new commercial enterprise falls into either of the following 2 groups:


  1. If they invest at least $1,000,000 in any enterprise anywhere in the U.S, or

  2. At least $500,000 in a argeted employment area (TEA).? TEA is an area that has experienced unemployment of at least 150 per cent of the national average rate or a rural area as designated by Office of Management and Budget (OMB). On annual basis, about 3,000 visas are set for the targeted employment area.



Advice to Investors


Potential investors are advised to conduct preliminary investigation on a number of issues before initiating their petitions on issues such as:


  1. geographical designation,

  2. both the state and federal law that may affect the investment,

  3. qualified investment amount,

  4. how to establish a new commercial enterprise,

  5. how to document that the investment fund comes from a lawful source,

  6. methodologies for proving that the requisite number of jobs would be created,

  7. that the investor will actively participate in the business, and

  8. process of creating employment particularly in cases involving a argeted employment area?/li>
